License for Order Fulfillment (User Design Content): By uploading photos or images for the purpose of creating a product ("User Design Content"), you grant FurFam a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, and display said User Design Content solely for the purpose of fulfilling your order, providing customer support, and generating the digital previews necessary for the Service. We will not use your User Design Content for marketing or advertising purposes without your express permission.
License for Public Contributions (Reviews & Social): If you voluntarily post content to public areas of the Services, such as leaving a product review, posting a photo in a review, or tagging us on social media where we have requested permission to repost ("Public Contributions"), you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to use, copy, reproduce, distribute, publish, and exploit your Public Contributions for any purpose, commercial, advertising, or otherwise.

Note on Product Photos: As stated in Section 2, the broad license in this Section 9 applies to Public Contributions (like reviews) and not to the original photos you upload solely for the purpose of order processing, which are restricted to use for fulfillment only.
We may provide you areas on the Services to leave reviews or ratings. When posting a review, you must comply with the following criteria: (1) you should have firsthand experience with the person/entity being reviewed; (2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hateful language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) your reviews should not contain references to illegal activity; (5) you should not be affiliated with competitors if posting negative reviews; (6) you should not make any conclusions as to the legality of conduct; (7) you may not post any false or misleading statements; and (8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of Texas applicable to agreements made and to be entirely performed within Texas.
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available at the American Arbitration Association (AAA) website. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules. If such costs are determined by the arbitrator to be excessive, we will pay all arbitration fees and expenses. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in El Paso, Texas. Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in El Paso, Texas, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Legal Terms.
In no event shall any Dispute brought by either Party related in any way to the Services be commenced more than 1 years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. At FurFam, we know that your pet is one-of-a-kind, and your custom gear should be too. Because every product we make is 100% personalized with your pet’s photo and name, we cannot accept standard returns for unwanted items (as they can’t be resold).
However, we stand behind our 100% Happiness Guarantee. Here is how we handle specific situations to ensure you are purr-fectly satisfied:
If you are disappointed with your order for any reason, please contact us at [email protected] within 30 days of receiving your item. We handle these on a case-by-case basis with the goal of making you happy:
Design Issues: Before you place your order, you will see a mockup of the exact design that you will receive. Please review this carefully for spelling and other issues. If you do not like your design, please upload a new photo to see a different artistic interpretation. If your pet's name is mispelled, please correct it by uploading the same photo with your pet's name and regenerate the design. This will fix the typo in 99% of cases. But don't worry, we also manually review each order to fix any typos for you. And rest assured, if you placed an order and don't like the design or still see a typo on the design, we will work with you to approve a new design and send you a free replacement.
Product Quality: If you are unhappy with the material or quality of the physical product itself (e.g., fit, texture), we will issue a full refund to your original payment method.
If your item arrives damaged, misprinted, or defective, you do not need to return it. Simply email us a photo of the issue, and we will send a free replacement immediately.
We know how exciting it is to wait for your new goodies! If your tracking number shows no movement for 7 days, or if the carrier states the package is lost, we will reprint and reship your order at no cost to you immediately.
We want to get you your order as soon as possible! Because we begin making your custom pet portrait shortly after you order, cancellations must be requested within 6 hours of purchase. After this window, we may be unable to cancel the order if production has already begun.
